January 2021 is a month that Dominic Jones, one of our most experienced personal injury lawyers, will never forget. This is because it was in January of this year that a young Polish man walked into our offices in Crewe to ask if we could help him recover compensation for serious injuries sustained in a motorbike accident of which he had absolutely no memory. 

It was a request that would have sent most lawyers running for the hills, but one that sparked Dominic’s interest and which he therefore agreed to investigate.  What happened next is remarkable and shows why Dominic is deservedly recognised as an expert in his field. 

The accident

All the client could tell us about the circumstances in which he was hurt is that he had been riding his motorbike on his way to work, one morning in January 2019, when he had been involved in a road traffic accident which had left him severely injured.

He knew he was somewhere near Sandbach, but he could not tell us the road he was travelling on and he had no idea whether the accident was his fault or had been caused by someone else.

His injuries

The injuries he had suffered were extensive and severe. They included fractures to his jaw, cheekbone, skull, shoulder blade, wrist and foot, torn ligaments in his knee and psychological trauma.  He had already had to undergo three operations to try to repair the damage, and was also awaiting further surgery on his knee and back.

As a result of the injuries he had sustained, he had been left unable to work and given that he now struggled to lift heavy items or to stand upright for any significant period of time, the prospects of him being able to resume employment as a manual worker were extremely slim.

Our investigations

We had very little to go on, so Dominic really needed to think outside the box.  Fortunately this is something he does very well, and accordingly it was not long before he had formulated a plan to find out exactly what had happened.

His first step was to contact the police to ask them whether the accident had been reported.  Thankfully it had, and an examination of the very brief report that had been prepared revealed the road where the accident occurred and the fact that another vehicle had been involved.  It also named the person who was driving that vehicle.

His next step was to use Google Maps to locate the road where the accident happened and to examine the surrounding area, so that he could assess how the client’s motorbike and the other vehicle could have come to collide with each other.

It turns out that there is a cross-roads near to where the accident occurred and, given where the motorbike and other vehicle ended up following the collision, it seemed likely that what had happened was that the other vehicle had pulled out from a side junction and hit our client as he was travelling along the main road.   

Armed with this information, Dominic was able to conclude that the accident was not our client’s fault and that because it occurred less than three years ago it was now possible for a compensation claim to be pursued. 

The claim

Having carefully pieced together what had happened, Dominic was able to prepare a comprehensive letter of claim to send to the insurer of the other driver, and which was sufficiently compelling to mean that they admitted liability for the accident straight away and agreed without argument to pay £236,000.

They also agreed, prior to the claim being settled, to fund the cost of a rehabilitation company being appointed to assess the client’s immediate care and treatment needs, and to pay for him to meet regularly with a local Polish speaking counsellor.  A plan was also agreed to enable him to retrain to do something other than manual work.

How our client is now

While the nature of the client’s injuries mean that his recovery is still ongoing, he now has long term financial security and funds available to ensure that he can access the support and care that he needs. He is investing his money and planning on beginning work in a new industry.
