Serious Injury Claims
Our injury claim experts have particular expertise in claims involving serious head and brain injuries, limb loss and amputations, full and partial paralysis and severe post-traumatic stress disorder (PTSD).
Our clients know they are in safe hands with us, as we provide a free initial assessment to determine whether a claim may be possible.
It may also be possible for us to act on your behalf where other solicitors have said that a claim is not possible (given our experience in handling unusually complex cases). Arrange a free, no obligation appointment with us today.
When can I make a serious injury claim?
As professional experts, we will assess the circumstances in which your accident occurred, tell you we think a claim is possible and, if so, how likely it is that any claim you make will succeed.
What does the claims process involve?
Stage 1.
First, we’ll need an assessment of your case to decipher whether a claim is possible.
Stage 2.
We’ll then determine where the responsibility for your accident lies, ascertain who you can sue and decipher whether the person identified can settle a claim made, for example, under the terms of their insurance.
Stage 3.
We’ll then evaluate how much compensation you are entitled to receive. This outcome depends on the extremity of your injury and the impact it has had (or will have) on your future life experience and finances. You will need to attend one or more medical appointments as part of this process, which we appreciate may be distressing but is integral to ensuring that your claim is assessed as accurately as possible.
Stage 4.
Then, we’ll begin negotiations with the person you’ll be making the claim against to see if they will agree to an out of court settlement and an interim payment. This payment could be an upfront payment of part of the compensation you will eventually receive.
Stage 5.
The final stage is the instigation of court proceedings (in the event that an amicable resolution cannot be agreed).
Through each stage, our solicitors will stand by you and practise excellent communication so you know where you stand. You can be assured that you’re in good hands.
Most serious personal accident claims will require all five stages to take place. However, it is rare for a case to require a formal hearing before a judge because a mutually acceptable settlement is nearly always agreed upon at some point before this becomes necessary.
How long does the claims process take?
We understand that this can be off-putting for many people, however, it is crucial to say that by being patient, you can ensure you receive the total amount of compensation to which you are entitled after your claim is processed to completion with care.
A positive of this is that you can spend the time it takes to resolve your case to focus on recovering, usually with the benefit of specialist rehabilitation services. We can help you to access this with the support of one or more interim payments provided by your opponent.
