Residential Property Conveyancing

During the process of buying, selling or remortgaging a property, you will probably have heard the term ‘conveyancing’ mentioned a few times. What does it mean, and how does it work? We’re here to help.

Conveyancing is the legal process all buyers and sellers have to go through to formally complete the property transaction they have agreed to enter, the components of which will vary depending on what they want to achieve.

Our lawyers can help with the buying, selling or remortgaging of private homes, holiday lets, buy-to-let investments, residential property portfolios and the homes of people who have gone into long-term care or have passed away. Find out what else our professional experts can help with here.

Residential Property Remortgage

Are you looking to remortgage your home or a buy-to-let investment property to switch from one mortgage product to another (e.g. from fixed to variable rate)? To move from your current lender to a new provider or access some of the value you have built up in your property via an equity release to fund home improvements or other necessities.

Our residential remortgage lawyers are certified professionals who manage the remortgage of holiday rentals and family homes to buy-to-let properties and large, privately owned residential investment portfolios. We offer a fast and efficient service for a fixed cost that covers your legal fees and disbursement costs (associated legal expenses).

Transfer of Equity

There are two ways someone can transfer a property out of their name and into someone else’s name: a transfer of equity or a conventional sale.

Based in Cheshire, our productive and dedicated transfer of equity lawyers assist a wide range of clients and support them throughout their individual processes. From clients who have decided they want to change the ownership arrangements in respect of a property, either by taking a name off or by adding a name on, and whether it be via a partner-to-partner transfer for tax purposes, a transfer from parents to children to facilitate a planned inheritance or simply a wish between co-owners to transfer full ownership to just one of them, either by way of gift or in return for some form of consideration.

Buying a New Build Home

There are many advantages to purchasing a new build property, such as picking out new appliances and moving into a clean and freshly decorated home. One particular advantage of buying a newly built property is feeling secure in the knowledge that should anything go wrong with the property? The buyer will benefit from a new build guarantee to call on, which will usually keep them protected for ten years.

Our knowledgeable lawyers specialise in residential conveyancing and have the skills and expertise needed to ensure that a property purchase proceeds efficiently with minimal complications. Our talented team works hard to remove the hassle from the transaction by doing as much leg work as possible for the buyer. All of our conveyancing soliciting teams are here to help while ensuring that our clients are regularly informed at each stage via detailed updates.

Unregistered Property

What is an unregistered property?

An unregistered property is owned, but hasn’t been registered with the Land Registry, meaning that the property’s details, documentation and ownership status can only be found in the Title Deeds. There are a few difficulties that may occur when you are looking to buy or sell an unregistered property, such as:

  • Finding who the legal owners are without a central record of the ownership to search for in the Land Registry
  • Proving who the legal owners are without a central record of the ownership to search for in the Land Registry

If you were looking to sell an unregistered property, the physical title deeds would need to be available to be passed on to the buyer’s conveyancer following the sale. With this transfer completed, the buyer would then be able to apply for the property to be registered. As the seller, you would also have to provide evidence of title to the buyer (via your conveyancer) by presenting documents proving physical ownership from the last 15 years up until the present day.

Our fantastic team of conveyancing specialists are experienced in the buying and selling of unregistered properties. Our conveyancers act as a reliable, trustworthy and productive helping hand while you go through this process.

Auction Property

Buying a property at auction comes with many advantages, such as a faster purchase process or winning a great deal on price. Another advantage is knowing for certain that once the hammer has fallen, the property will belong to the winning bidder – subject to them being able to pay a 10% deposit on the day the auction takes place and the balance of the agreed price within another 28 days.

We have experience in auction property services and can support you with each step of the process. We handle transactions of all sizes and will assist you with the property you are bidding for, whether it will take place in a matter of days, weeks or months.

Buy to Let Property

If you’re looking to buy or sell a property, you will need the assistance of an experienced residential conveyancing lawyer who can attend to all legal formalities required. These necessities include transferring ownership of the property into or out of your name to comply with your mortgage lender’s requirements and to ensure that your financial and personal interests remain protected.

We specialise in the buy-to-let property acquisition and make it our priority to support our clients and to ensure sensible and informed investment decisions are made. Our service is fast, efficient and productive, provided for a pre-agreed cost and designed to deal with as much of the process as we can to support you through each stage.

Buying a property through a shared ownership scheme is a great way to get on the property ladder, but the process isn’t always as simple as it sounds. To make the process smooth and fast, you should appoint an experienced conveyancing solicitor to ensure that your purchase proceeds as simply as possible so that you can pick up your keys in a minimal amount of time.

Our expert service is delivered at a competitive cost and explained to you in simple, jargon-free language. Our lawyers offer specialist advice on shared ownership home transactions and have experience dealing with new build properties and existing housing stock.
